Terms of Service

These Terms of Service ("Terms") govern your use of Simple Guests, a software service operated by SMN Properties OÜ ("we", "us", "our"). Simple Guests is a brand of SMN Properties OÜ. By creating an account or using the service, you agree to these Terms.

1. The service

Simple Guests helps hotels, hostels, and similar accommodation providers collect guest registration data, run digital check-in (including ID scan and signature), and submit or retain compliance records for configured authorities (for example SES.HOSPEDAJES and Mossos d'Esquadra in Spain, or the fiche individuelle de police in France). Features depend on your subscription plan, selected integrations, and jurisdiction configuration.

2. Accounts and billing

You must provide accurate organization and contact details. Subscription fees are billed monthly through Stripe based on the number of properties, integration add-ons, and usage (per compliant check-in) shown at signup and in your dashboard. Each property receives its own guest check-in link. You are responsible for keeping payment details current and for charges incurred under your account.

3. Your responsibilities

• You must have a lawful basis to collect and process guest personal data and to transmit it to authorities.
• You configure government credentials and review extracted guest data before submission where required.
• You must not misuse the service, attempt unauthorized access, or upload unlawful content.
• You remain the data controller for guest personal data; we act as your processor for hosting and transmission.

4. Availability and changes

We aim for high availability but do not guarantee uninterrupted service. We may update features, pricing, or these Terms with reasonable notice where required. Continued use after changes constitutes acceptance.

5. Limitation of liability

To the maximum extent permitted by law, SMN Properties OÜ is not liable for indirect or consequential damages, or for compliance penalties arising from incorrect data you approve or credentials you supply. Our aggregate liability is limited to fees paid in the twelve months before the claim.

6. Termination

You may cancel your subscription through the billing portal. We may suspend or terminate access for breach of these Terms or non-payment. Upon termination, data retention follows our Privacy Policy and applicable law.

7. Governing law and contact

These Terms are governed by the laws of Estonia, without prejudice to mandatory consumer protections in your country. Questions: hello@simpleguests.com.
